Welcome to Keystone Tides Mental Health! By accessing and using our website and services, you acknowledge and agree to be bound by the following terms (these “Terms of Service”). These Terms of Service govern the provision of psychiatric and mental health care through our telehealth platforms.

1. Eligibility and Agreements

To use our services, you must:

  • Be a resident of the state of Washington;
  • Be at least 13 years old, or have parental/guardian consent if a minor;
  • Agree to these Terms of Service.

By accessing the website or using our services, you hereby confirm that you are legally able to consent to receive services, or have the consent of a parent or guardian, and are legally able to enter into a contract.

MINOR CONSENT: Where consent from a parent or guardian is required to receive our services, you hereby confirm that as the consenting parent or guardian, you have the sole right to consent to our services for the minor seeking therapy and are not legally mandated to confer with or get consent from any other legal guardian before consenting. You also give affirmative consent to the provisions set forth in the accompanying Privacy Policy regarding the collection, process, and use of personal information on behalf of the minor. You also agree that consent to our services remains valid until the provider patient relationship is terminated.

You hereby confirm and agree that all the information that you provided on or through the website, and the information that you will provide on or through the website in the future, is accurate, true, current, and complete. Furthermore, you agree that while using the website or our services, you will make sure to maintain and update this information so it will continue to be accurate, current, and complete.

You acknowledge and agree that you are responsible for maintaining the confidentiality of your password and any other security information related to your account (collectively “Password”). We advise you to change your Password frequently and to take extra care in safeguarding your Password.

You agree to notify us immediately of any unauthorized use of your Password or any other concern for breach of your account security.

You acknowledge and agree that we will not be liable for any loss or damage that is incurred as a result of someone else using your Password, either with or without your consent and/or knowledge.

You acknowledge and agree that you are solely and fully liable and responsible for all activities performed using your Password. You further acknowledge and agree that we will hold you liable and responsible for any damage or loss incurred as a result of the use of your Password by any person whether authorized by you or not, and you agree to indemnify us for any such damage or loss.

You acknowledge and agree that your use of the website, including our services, is for your own personal use only and that you are not using the website or our services for or behalf of any other person or organization.

You agree not to interfere with or disrupt, or attempt to interfere with or disrupt, any of our systems, services, servers, networks or infrastructure, or any of the website’s systems, services, servers, networks or infrastructure, including without limitation obtaining unauthorized access to the aforementioned.

You agree not to make any use of the website for the posting, sending or delivering of any of the following: (a) unsolicited email and/or advertisement or promotion of goods and services; (b) malicious software or code; (c) unlawful, harassing, privacy invading, abusive, threatening, vulgar, obscene, racist, or potentially harmful content; (d) any content that infringes a third party right, including intellectual property rights; (e) any content that may cause damage to a third party; (f) any content which may constitute, cause, or encourage a criminal action or violate any applicable law.

You agree not to violate any applicable local, state, national or international law, statute, ordinance, rule, or regulation in relation to your use of the website and your relationship with us.

If you receive any file from us, whether through the website or not, you agree to check and scan this file for any virus or malicious software prior to opening or using this file.

2. Services Offered

We offer the following telehealth psychiatric services:

  • Medication management;
  • Therapy services;
  • Referrals to supportive services and resources.

3. Privacy and protection of personal information

We collect, process, and use information about you as described in our Privacy Policy. By using the website, you are also agreeing to the terms of the Privacy Policy. The website uses cookies, as described in the Privacy Policy. By using the website, you agree to the processing of your information and the use of the necessary cookies.

4. Appointments and Cancellations

Appointments can be scheduled through our website or by contacting our office directly. We require 24 hours’ notice for cancellations or rescheduling. Failure to do so may result in a fee.

5. Payment and Fees

We accept various insurance plans and self-pay options. Payments are due at the time of service for self-pay clients. For insured clients, you are responsible for any co-pays, deductibles, or other expenses not covered by your insurance. Late fees may be applied to unpaid balances.

You agree to use only credit cards or other payment means which you are duly and fully authorized to use, and that all payment related information that you provided and will provide in the future, to or through the website, is accurate, current, and correct and will continue to be accurate, current, and correct.

You agree to pay all fees and charges associated with your account on a timely basis and according to the fee schedules, the terms, and the rates as published on the website. By providing us with your payment information you authorize us to bill and charge you through that payment information and you agree to maintain valid payment information in your account.

6. Patient Responsibilities

By using our services, you agree to:

  • Provide accurate and complete health and personal information;
  • Use our telehealth platform appropriately and maintain a secure internet connection; and
  • Be available for scheduled appointments and notify us in advance of any changes.

7. Telehealth Disclaimer

While we strive to provide high-quality care, telehealth has its limitations. In certain situations, in-person care may be necessary. Telehealth is not suitable for emergencies; if you are experiencing a mental health crisis or life-threatening situation, please call 911 or visit the nearest emergency room.

8. Limitation of Liability

All information contained on, or accessible through, the website is provided on an “AS IS” basis. Keystone Tides Mental Health does not warrant that it is accurate, complete, current, or reliable. You use the website at your own risk.

KEYSTONE TIDES MENTAL HEALTH DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, TO THE FULLEST EXTENT PERMITTED BY LAW. KEYSTONE TIDES MENTAL HEALTH SPECIFICALLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF MERCHANTABILITY, WHETHER EXPRESS, IMPLIED OR STATUTORY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

In no event shall Keystone Tides Mental Health be liable for any special, indirect, or consequential damages or any damages whatsoever resulting from loss of use, data, or profits, whether in an action of contract, negligence, or other tortuous action, arising out of or in
connection with the use or performance of information available from the website. In the event this disclaimer of damages is not enforceable, damages shall be limited to $1.00 USD.

To the fullest extent permitted by law, Keystone Tides Mental Health is not liable for any damages resulting from:

  • Issues with telehealth platforms, such as technical difficulties;
  • Inaccurate or incomplete information provided by the patient; and
  • Delays or disruptions in service beyond our control.

9. Termination of Services

We reserve the right to terminate your access to our services at any time for any reason. Should termination become necessary, you will receive a notice through your patient portal. Additionally, we will ensure a smooth transition by providing referrals, releasing your information as authorized, and supplying a minimum of a 30-day fill of your current medication to ensure continuity of care.

10. Dispute Resolution

We have the right to determine whether there has been a violation of these Terms of Service. If we determine the Terms of Service have been violated, we have the right to determine the action that will be taken. The action to be taken may include (but not be limited to):

  • Immediate removal of any content posted by you to the website or patient portal;
  • Issuance of a warning or other communication to you;
  • Legal proceedings against you, including seeking damages (including indemnity) recovering all costs and losses suffered as a result of your violation of the Terms of Service; and
  • Referral to law enforcement agencies for further action.

We will not be liable for any damages which you may suffer as a result of the foregoing actions. Should disputes arise, we encourage direct resolution. If unresolved, disputes regarding the website or our services will be addressed through mediation or arbitration in accordance with Washington state law.

These Terms of Service constitute the entire agreement between you and us. You agree that you have not relied upon any promises or representations by us except as set forth in these Terms of Service.

11. Changes to Terms of Service

We may update these Terms of Service periodically. Any changes will be posted on our website, and continued use of our services after such changes implies acceptance of the revised terms.
